Terms of Service

These Terms of Service ("Terms") apply to freelance software development services provided by Vikas Vijendrabhai Ajudiya, an individual freelance software developer based in Surat, Gujarat, India ("I", "me" or "my"), to clients ("you") who engage me. By engaging me for a project, you agree to these Terms together with anything we specifically agree in writing for that project.

Services

I provide freelance software development services, which may include web development, mobile app development, Flutter development, backend and API development, and application maintenance and support. The exact services for each engagement are those described in the quote or proposal agreed for that project.

Quotes, scope and timelines

The scope of work, deliverables, price and timeline are agreed for each project in writing before work begins. Quotes and timelines are estimates based on the requirements known at the time. If the requirements or scope change, the price and timeline may need to be adjusted, and I will discuss this with you before continuing.

Payment

Payment terms — including any advance or staged payments — are agreed per project in the quote or proposal. Unless we agree otherwise in writing, invoices are due as set out in that agreement.

Your responsibilities

To deliver your project I may need content, access to relevant systems or accounts, and timely feedback and approvals from you. Delays in providing these may affect the agreed timeline. You are responsible for ensuring that any material you provide to me is lawful and that you have the right to use it.

Intellectual property

Unless we agree otherwise in writing, ownership of the custom work created specifically for your project transfers to you once you have paid for it in full. I may continue to use general knowledge, skills and techniques gained during the work, and any third-party or open-source components remain subject to their own licences.

No guarantee of specific outcomes

I provide my services on a professional, best-effort basis. While I work carefully to deliver quality software that meets the agreed requirements, I cannot guarantee specific business outcomes such as a particular amount of revenue, traffic, search ranking or commercial success, as these depend on many factors outside my control.

Third-party services

Projects may rely on third-party platforms, libraries or services (for example hosting providers, payment gateways or app stores). I am not responsible for the availability, performance, policies or charges of those third parties.

Limitation of liability

To the extent permitted by law, my total liability arising out of any project is limited to the fees you have paid me for that project. I am not liable for indirect or consequential losses such as loss of profit, data or business.

Governing law

These Terms are governed by the laws of India, and any disputes will be subject to the jurisdiction of the courts in Surat, Gujarat, India.
